Terms of service in full
These terms of service ("Terms") are an agreement between you and [Company legal name], which operates bypass.so ("bypass.so", "we", "us"). They apply to the bypass.so website, the customer dashboard and the API (together, the "Service").
- By creating an account, using an API key or otherwise using the Service, you accept these Terms, the Acceptable use policy and the Privacy policy.
- If you use the Service on behalf of a company or other organisation, you confirm that you are authorized to accept these Terms for it, and "you" includes that organisation.
- You must be at least 18 years old, or the age of majority where you live, to use the Service.
- The Service is intended for business and developer use. If you do not agree to these Terms, do not use the Service.
- Account: your registered bypass.so account, accessed through the dashboard.
- API key: the secret credential issued to your Account that authenticates API requests.
- Balance: the prepaid credit, in US dollars, available to your API key, including any Bonus credit.
- Bonus credit: additional promotional credit added to a single qualifying top-up.
- Task: a single request to answer one captcha, created with
POST /createTask. - Result: the answer or token we return for a Task.
- Customer content: the data you send in a Task, such as images, audio, text, page addresses and site keys.
- You must give accurate information when you register and keep your email address up to date, because we use it for important notices.
- Your API key is a secret. Keep it on your servers, never in client-side code or public repositories, and do not share it with anyone outside your organisation.
- You are responsible for all activity and all charges made with your API key, whether or not you authorized them, until you rotate the key.
- If you believe your API key or Account has been compromised, rotate the key from the dashboard immediately and tell us.
- We may suspend or rotate a key that we reasonably believe is compromised or being misused, and will tell you when we do.
- The Service returns Results for the task types listed on our website. We may add, change or retire task types and API features. We will give reasonable notice before retiring a task type you are actively using, where we can.
- Speed and success figures on our website describe typical performance. They are not guarantees for any individual Task.
- Whether a third-party website accepts a Result is controlled by that website and its captcha provider, not by us. Tokens can expire quickly and should be used once, straight away.
- We may set reasonable technical limits, for example on request rates or payload sizes, to protect the Service for all customers.
- The Service is prepaid. Prices are published per 1,000 successful Tasks on the pricing page and are charged in US dollars from your Balance.
- When you create a Task, its price is held on your Balance. The hold is charged when the Result is ready, and released back to your Balance automatically if the Task fails or cannot be completed.
- If you report a wrong Result with
POST /reportBad, the price of that Task is credited back to your Balance once per Task. We may limit or stop these credits if reports are used in a way that is not genuine. - Bonus credit is added to a single top-up that meets the published minimum. It has no cash value, cannot be transferred and does not combine across separate top-ups.
- Balance is not refundable and cannot be exchanged for cash, except where the law requires otherwise or where these Terms expressly say so. Failed Tasks and accepted wrong-Result reports are credited back to your Balance, not paid out.
- Price changes apply only to Tasks created after the change takes effect. We will publish new prices before they apply and give at least [14 days] notice of any increase by email.
- Prices exclude taxes unless stated. You are responsible for any taxes that apply to your purchases.
- If a payment is reversed or charged back, we may suspend the Account and deduct the reversed amount, including any Bonus credit linked to it, from your Balance.
Your use of the Service must follow the Acceptable use policy, which forms part of these Terms. In short:
- Use the Service only on websites and applications that you own, or that you are authorized by the owner to test or automate.
- Never use the Service for fraud, spam, credential stuffing, account takeover, fake account creation or any other unlawful or harmful activity.
- We may ask you to show that you are authorized for a given use, and may suspend the Service while we review it.
- You keep all rights in your Customer content. You grant us a limited licence to process it only to provide, secure and support the Service.
- You confirm that you have the rights and permissions needed to send each piece of Customer content to us.
- We handle Customer content as described in the Privacy policy. Task content is processed transiently to produce a Result and is not sold.
- We work to keep the Service available and fast, but we do not promise that it will be uninterrupted or error-free. Planned maintenance will be kept short and, where practical, announced in advance.
- Current API status is available at
GET /health. - Support is provided through our contact page. A service level agreement applies only if we have agreed one with you in writing.
- You may stop using the Service at any time and ask us to close your Account.
- We may suspend or close your Account, with or without notice, if you breach these Terms or the Acceptable use policy, if your use creates a security or legal risk, or if we are required to by law.
- If we close your Account because of your breach, any remaining Balance may be forfeited. If we close it for any other reason, we will refund your remaining paid Balance, excluding Bonus credit.
- Sections that by their nature should survive closure, including payment obligations, disclaimers, limitation of liability and indemnity, continue to apply.
- We and our licensors own the Service, including its software, design, documentation and brand. These Terms do not transfer any of those rights to you.
- You may use our documentation and code examples to build integrations with the Service.
- If you send us feedback or suggestions, we may use them without any obligation to you.
Except as expressly stated in these Terms, the Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that any Result will be accepted by a third-party website.
- To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.
- Our total liability arising out of or relating to the Service is limited to the amounts you paid us in the [three months] before the event giving rise to the claim.
- Nothing in these Terms limits liability that cannot be limited by law.
You will defend and indemnify us against third-party claims, and related losses and costs, that arise from your use of the Service in breach of these Terms, the Acceptable use policy or applicable law.
We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. For material changes we will give at least [30 days] notice by email or in the dashboard before they apply. Continuing to use the Service after that date means you accept the updated Terms.
These Terms are governed by the laws of [jurisdiction], without regard to conflict-of-laws rules. The courts of [venue] have exclusive jurisdiction, unless mandatory consumer law gives you the right to bring a claim elsewhere.
Questions about these Terms can be sent through our contact page. Postal address: [Company legal name], [registered address].
